Terms and Conditions

About these terms
These terms govern your use of the Insula3D desktop software (the "Software") and the license you buy for it. The Software is made and licensed by Insula3D ("we", "us"), a sole proprietorship registered in the Republic of Korea. Licenses are sold by our reseller Paddle.com, so you buy from Paddle and we license the Software to you. Our business details are under Contact below.
By buying a license, installing or using the Software, you agree to these terms.
Orders and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Your purchase is also subject to Paddle's Buyer Terms. Paddle calculates and collects any applicable sales tax or VAT.
Paddle handles payment, invoicing and refunds. Support for the Software comes from us, see Contact below.
License
When you buy a license, we grant you a perpetual, non-exclusive license, not transferable to another organization, to install and use the Software builds you are entitled to, for the number of seats stated in your order.
A seat is one person. That person may install and use the Software on the computers they use for your work. A seat cannot be shared between people, at the same time or in turns. You can move a seat to another person in your organization, for example when someone leaves.
You may not resell, rent or sublicense the Software, share your license key outside your organization, or reverse engineer the Software except where the law allows it.
The Software includes open-source components listed in its third-party notices. Each is licensed to you under its own license, which applies to it instead of these terms, and nothing in these terms limits your rights under those licenses.
The Software also includes Microsoft components, the Visual C++ runtime and the Microsoft Edge WebView2 installer, which you may use only as part of the Software. To the extent the law allows, Microsoft and our other suppliers give no warranty for them and are not liable for any damages arising from them.
You may not use the Software or our servers, insula3d.com and context.insula3d.com, for anything unlawful or fraudulent, or to infringe anyone else's rights. Do not get around the license check, send malware to our servers, probe them for weaknesses, or collect their content by automated means other than the Software.
Ownership
The Software is licensed, not sold. The Software and its documentation are the intellectual property of Insula3D and are protected by copyright law. No ownership rights are transferred by the purchase of a license.
You own the models, spreadsheets and output files you create with the Software.
Trademarks
Autodesk, 3ds Max and FBX are trademarks of the Autodesk group of companies. Insula3D is not affiliated with Autodesk. Blender is a registered trademark of the Blender Foundation. Khronos and glTF are trademarks of The Khronos Group Inc. buildingSMART and IFC are trademarks of buildingSMART International Limited. Microsoft, Excel and Windows are trademarks of the Microsoft group of companies. Insula3D is not affiliated with, endorsed by or sponsored by any of them. All other trademarks belong to their respective holders.
Support period and updates
Support lasts one year from the date of purchase. Your license key records the support end date. You can install any build released before that date. Builds you already have keep working after the support period ends.
To receive builds released after that date, renew your support. A renewal adds one year to your current support end date. If your support has already ended, the year still counts from that date, not from the day you renew. There is no other fee for renewing late.
If your support ended more than a year ago, one renewal will not bring it up to date. Email us before you buy and we will tell you how many renewals you need.
We may also offer fixes for correctness issues to licenses whose support has ended.
License key
The license key is a signed file stored on your computer, in your user profile folder or next to the program. The Software checks it offline: there is no online activation, and the Software does not sign in to an account. Keep the file secure, since anyone holding it can use your license. A copy of each key you buy is kept in your account on insula3d.com.
Output files generated by the Software carry the licensee name and build date in a comment or metadata field.
Trial
A trial key lets one person use the Software for 30 days from the day it is issued, to try it out. Each email address gets one trial. Output files made with a trial key are marked as trial output and are not for delivery to clients. When the trial ends, the Software asks for a license key you have bought.
Your account
You can create an account on insula3d.com with an email address and password, or with Google. Your account lists the licenses and keys bought with its email address and lets you download them again. Keep your password secure; you are responsible for what happens in your account. We can suspend an account if these terms are broken. You can delete your account in its settings, or by emailing support@insula3d.com from the address on the account. The keys you already have keep working after the account is deleted.
Refunds
Refunds are covered by our Refund Policy.
What the Software does and does not do
The Software converts 3D models and attribute spreadsheets to CityGML, CityJSON, IFC and other formats, and reports the problems its own checks find. It does not guarantee that your data meets a client's or a project's specification. Which specification applies is your decision.
IFC output is intended for reference, coordination and review. Geometry is written as mesh faces and cannot be edited in the receiving tool the way a natively modeled element can.
The Software runs on your computer. We do not receive your models or files.
Warranty disclaimer
To the extent permitted by law, the Software is provided "as is", without warranties of any kind, including fitness for a particular purpose. Check converted output before you deliver it.
We do not warrant that the Software, or our download and context building servers, will be uninterrupted or error-free.

Limitation of liability
To the extent permitted by law, our total liability for any claim relating to the Software is limited to the amount you paid for the license concerned. We are not liable for indirect or consequential losses, including loss of data, profit or business.
Ending a license
We can end your license if you break these terms, for example by sharing your license key outside your organization, if the payment for it is refunded, reversed or charged back, or if it was obtained by fraud. We will tell you by email, and you must then stop using the Software.
Changes to these terms
If we change these terms, we will update this page and the date at the top, and notify Paddle of the change.
